Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the WHIZPLAN mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
WHIZPLAN is a trip planning application. It allows you to organize trips, manage itineraries, and find locations.
- Trip Data: Stored locally on your device.
- Account Services: We provide cloud-based accounts for managing "Travel Credits" (digital goods).
- Billing: We use Google Play and Apple App Store for payments.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on devices you own or control.
4. User Responsibilities
You agree to:
- Use the App in compliance with all applicable laws and regulations
- Maintain the confidentiality of any sensitive information you store in the App
- Take responsibility for backing up your data
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App for any illegal or unauthorized purpose
- Not interfere with or disrupt the App's functionality
5. Data Storage and Privacy
We operate on a hybrid model:
LOCAL STORAGE
Your Trip Plans, Itineraries, and Saved Places are stored on your device. We do not access them.
CLOUD STORAGE
Your Account Info (Email, ID) and Purchase History are stored on our secure servers to manage your credits.
FINGERPRINTING
We collect device identifiers for security and fair use enforcement.

6. Third-Party Services & Payments
Payments:
- Payments are processed by Apple (App Store) or Google (Play Store).
- We do not store your credit card information.
- All transactions are subject to the Terms of the respective store.
Other Services:
- Google Maps Platform (Maps)
- Weather Services
7. Travel Credits & Digital Goods
- "Travel Credits" are licensed digital goods, not currency.
- Credits are non-refundable, except as required by law or platform policy.
- Credits are tied to your account and may be synced across devices.
8. Intellectual Property
The App, including its original content, features, and functionality, is owned by WHIZPLAN and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS"
The App is a planning tool intended for general informational purposes only. It is NOT a substitute for professional legal, medical, or travel advice.
We do not guarantee that the App covers all applicable laws, regulations, health requirements, safety advisories, or entry requirements for your destination.
You acknowledge that travel regulations and local laws are subject to frequent change. You are solely responsible for verifying all information with official government sources.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHIZPLAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Device Permissions
The App requests permissions for Location, Storage, Camera, and Internet. You can manage these in device settings.
12. Termination & Fair Use
We reserve the right to ban or restrict devices/accounts that abuse the service, attempt to circumvent quota limits, or violate these Terms. We monitor device fingerprints for this purpose.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation or, if necessary, mediation or arbitration in White River, South Africa.
